Terms & Conditions
The terms on which we supply AccessPulse — written to be read, not to be skipped.
Last updated: 6 September 2026
1. What AccessPulse is — and what it is not
AccessPulse is a user-facing accessibility toolbar. A visitor opens it and adapts the page to their needs: contrast, text size, spacing, a reading ruler, text-to-speech, reduced motion, and other tools.
Please read this part carefully. AccessPulse helps you address a number of WCAG success criteria and helps real people use your website today. It does not make your website compliant with WCAG, the ADA, Section 508, EN 301 549, the European Accessibility Act, GIGW, or any other standard or law, and we do not represent that it does.
The widget adjusts how an existing page is presented. It cannot create content that is not there. In particular it cannot fix missing or incorrect image alt text, unlabelled form fields, keyboard traps or broken focus order in your own JavaScript, semantics faked with generic elements instead of real headings and buttons, inaccessible PDFs or embedded third-party content, or missing video captions and transcripts. Those require work on your website itself.
Compliance depends on your whole site, your content and your own processes. We give no warranty about your legal position and we do not provide legal advice. If you need an opinion on your exposure, consult a lawyer.
2. Accounts
There are two ways to open an account, and they differ only in whether we have to do anything.
- Choose a plan and pay by card. The account is created and activated when the payment succeeds, and your widget works immediately. Nobody reviews it first.
- Register without choosing a plan. The account is created pending: it exists and your password is set, but nothing works until we activate it and assign a plan. We arrange payment with you directly.
You are responsible for the accuracy of your details, for keeping your password safe, and for everything done under your account. Tell us promptly if you think it has been compromised.
3. Subscriptions and billing
Plans differ in how many websites they cover and which tools are enabled. Prices are shown on our pricing page in both USD and INR.
Indian prices are inclusive of GST at 18%. The figure shown on the pricing page is the figure charged — we do not add tax at the checkout — and your tax invoice sets out the taxable value and the tax separately, adding up exactly to the amount debited.
- Monthly — billed for a one-month term.
- Yearly — billed for eleven months and you receive twelve. One month free, applied up front.
You can pay by card when you sign up. Card payment is currently available for payments in INR; for USD, or to pay by bank transfer, contact us and we will arrange it and apply it to your account.
Each payment buys one term outright — one month or one year. We do not store your card, we do not set up a mandate or standing instruction, and nothing renews automatically. When a term is coming to an end it is for you to renew it; if you do not, the subscription simply expires.
A subscription runs to its expiry date; after expiry there is a seven-day grace period during which the widget keeps working, after which it stops appearing on your sites until the subscription is renewed.
A GST tax invoice is issued for every payment and emailed to the address on the account, and can be downloaded again from your account at any time. If you supply a GSTIN we put it on the invoice so the tax is claimable; we need a billing address with it, because an invoice to a registered person must carry one.
Your first paid term carries a 14-day money-back guarantee — ask within 14 days of that payment and we refund it in full, no reason needed. After that window, and on renewals, fees already paid are not refundable except where the law requires otherwise. The Refund & Cancellation Policy sets out the detail, including how to cancel and how refunds are paid, and forms part of these terms.
We may change our prices. A change never applies to a term you have already paid for, and because nothing renews automatically it can never take a different amount from you than the one you agreed: the price you see when you choose to renew is the price you pay.
4. Your responsibilities
- You may install the widget only on domains you own or are authorised to manage, and you must register each of those domains against your site key. Keys are locked to their registered domains and will simply not work elsewhere.
- Do not resell, sublicense or white-label the service except under a partner agreement with us.
- Do not attempt to reverse-engineer, disrupt or overload the service, or use it for anything unlawful.
- Do not misrepresent what the widget does — in particular, do not claim to your own customers or users that installing it makes a site compliant or certified.
- Keep your account details current so we can reach you about renewals and service matters.
5. Partners
Partners buy customer licences in bulk on agreed wholesale terms and onboard their own clients against a purchased allowance. Partner applications are reviewed and approved by us, and the allowance is set when we approve you. Once your allowance is used you cannot register further customers until more is purchased. Partner pricing is confidential and is not published.
A partner is responsible for their own customers' use of the service and for making sure those customers understand section 1 of these terms.
6. Availability
We work to keep the service available and we monitor it, but we do not currently offer a contractual uptime guarantee or service credits. We may take the service down for maintenance and will give notice where we reasonably can. Our pricing page describes pageviews as unmetered; that is offered in good faith for normal website use, and we reserve the right to talk to you about usage that materially affects other customers.
7. Data
Our Privacy Policy explains what we collect and why, and forms part of these terms. In short: visitor analytics from the widget are stored against a one-way hash of the IP address rather than the address itself, we do not sell data, and we do not track visitors across sites. Analytics on this website run only if you accept analytics cookies.
For data your visitors generate through the widget, you are the controller and we act as your processor.
8. Intellectual property
We own the AccessPulse software, brand and documentation. Your subscription grants you a non-exclusive, non-transferable right to use the widget on your registered domains for as long as your subscription is active. You keep ownership of your own website content.
9. Liability
To the fullest extent the law allows, we are not liable for indirect or consequential loss, for lost profits or goodwill, or for any accessibility claim, complaint or proceeding brought against you. Our total liability in any twelve-month period is limited to the fees you paid us in that period.
Nothing here excludes liability that cannot lawfully be excluded.
10. Suspension and termination
You may stop using the service at any time; your subscription then runs to the end of its paid term. We may suspend or terminate an account for non-payment, for breach of these terms, or where use of the service is unlawful — and, other than for serious breach, we will give you notice and a chance to put it right first.
11. Changes to these terms
We may update these terms. Material changes will be notified to customers by email, and the date at the top will change. Continuing to use the service after a change means you accept it.
12. Governing law
These terms are governed by the laws of India, and the courts of India have exclusive jurisdiction.
